Pampered Artist

Introduction Welcome to Pampered Artist. These Terms of Service ("Terms") govern your access to and use of our services, including in-studio and mobile guided paint parties, online booking tools, classes, workshops, events, materials, and any content or communication provided by Pampered Artist ("we," "us," "our"). By booking, attending, purchasing, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, do not access or use our services.
Eligibility: You must be at least 18 years old to create an account or make a reservation as a primary booker. Minors may attend sessions only when accompanied by a responsible adult and in compliance with any age restrictions for specific events. By booking, you represent and warrant that you meet these eligibility requirements.
Bookings, Reservations, and Payments a. Booking: Reservations may be made via our booking platform, by phone, or in person. All reservations are subject to availability and confirmation. b. Payment: Payment is required as specified at the time of booking. We accept the payment methods listed on our booking page. You authorize us to charge your chosen payment method for the full amount, including applicable taxes, fees, and any applicable deposits. c. Deposits and Holds: Certain private events, off-site parties, or special packages may require a non-refundable deposit or credit card hold to secure the date. d. Price Changes: We reserve the right to change prices for services, materials, fees, and taxes at any time. Changes do not affect confirmed bookings unless required by law.
Cancellations, Rescheduling, and Refunds a. Our Policy: Cancellation and rescheduling policies are provided at the time of booking and may vary by class, event type, or private-party agreement. It is your responsibility to review the policy that applies to your booking. b. Refunds: Refunds are issued according to the specific policy applicable to your booking. Deposits for private events are typically non-refundable unless otherwise stated in a written agreement. c. No-Shows: Failure to attend without timely cancellation will result in forfeiture of payments and may incur additional charges. d. We may cancel or reschedule events for reasons including (but not limited to) instructor availability, weather, venue issues, safety concerns, or insufficient enrollment. If we cancel, we will make commercially reasonable efforts to notify you and offer a refund or reschedule option.
Attendance, Conduct, and Safety a. Arrival: Please arrive at the scheduled time. Late arrivals may miss instruction or parts of an activity; refunds are not typically provided for late arrival. b. Conduct: All attendees are expected to act respectfully and follow instructor directions. We reserve the right to remove any participant who engages in disruptive, abusive, or unsafe behavior without refund. c. Safety: Some activities involve paints, tools, and other materials. By participating, you acknowledge risks and agree to follow all safety instructions. You are responsible for notifying staff of any allergies, medical conditions, or other concerns prior to participation. d. Alcohol: If alcohol is served at an event, you must be of legal drinking age and consume responsibly. We reserve the right to refuse service and remove patrons who appear intoxicated.
Materials, Artworks, and Supplies a. Materials Provided: Our session fees typically include basic materials and guidance. Specific inclusions are set out at the time of booking. b. Use and Care: Unless otherwise specified, materials provided are for single-session use only and remain our property until any stated transfer (for example, finished canvases provided with certain packages). c. Take-Home Artwork: Completed artwork that you take home is your creative work. We are not responsible for damage to take-home items after they leave our possession. d. Storage: We are not obligated to store artworks beyond any period expressly provided; unclaimed items may be discarded after notice as permitted by law.
Intellectual Property a. Ownership: All content provided by Pampered Artist, including class instructions, designs, templates, images, logos, and training materials, is owned by or licensed to us and protected by copyright and other intellectual property laws. b. Limited License: We grant you a personal, non-exclusive, non-transferable license to use any materials provided for your private, non-commercial enjoyment. You may not reproduce, distribute, publish, sell, modify, or create derivative works from our copyrighted materials without our prior written consent. c. Participant Creations: You retain ownership of original artworks you create at our events. However, by participating you grant Pampered Artist a non-exclusive, royalty-free, worldwide license to photograph, film, or otherwise record images of you and your artworks for marketing.
